Terms of Service

These Terms of Service ("Terms") form an agreement between you and the independent developer of FitMyLife ("we", "us", "our"), a sole trader based in New South Wales, Australia, governing your use of the FitMyLife mobile application (the "App"). By downloading or using the App, you agree to these Terms. If you do not agree, please do not use the App.

1. The App

FitMyLife is a personal fitness, activity and wellness tracking tool. It lets you record workouts and nutrition, view health and activity data from Apple Health, set goals, and (optionally) track other wellness information. Your data is stored on your device as described in our Privacy Policy.

2. Not medical advice

FitMyLife is not a medical device and does not provide medical advice, diagnosis or treatment. This includes any nutrition estimates, calorie figures, activity insights, and cycle or fertility predictions, all of which are informational and approximate. Do not rely on the App for medical decisions. Always consult a qualified health professional regarding any medical condition, before starting an exercise or nutrition program, or before acting on any information in the App. If you think you may have a medical emergency, call your local emergency services.

3. Eligibility

You must be at least 16 years old to use the App. By using the App you confirm that you meet this requirement.

4. Free trial and subscription

FitMyLife offers a 21-day free trial, after which continued access to paid features requires a paid subscription. Pricing is shown in the App before you purchase.

  • Subscriptions are sold and processed by Apple through the App Store, and are billed to your Apple Account. We do not process or receive your payment details.
  • Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours prior to the end of the current period.
  • You can manage or cancel your subscription, and turn off auto-renewal, in your Apple Account settings (Settings → your name → Subscriptions) at any time.
  • Except where required by law, payments are non-refundable. Refund requests for App Store purchases are handled by Apple under Apple's policies.

5. Acceptable use

You agree not to:

  • reverse engineer, decompile, or attempt to extract the source code of the App, except to the extent this restriction is prohibited by law;
  • interfere with, disrupt, or attempt to gain unauthorised access to the App or any systems or networks it connects to;
  • use the App in any way that breaches any applicable law, or to infringe the rights of others;
  • misuse the third-party services the App relies on (such as the AI meal-analysis and exercise/food reference services).

6. Your content

You retain ownership of the information and photos you enter into the App. Because that content is stored on your device, you are responsible for it and for keeping your own backups. When you use the meal-analysis feature, you grant us and our AI provider permission to process the photo or text you submit solely to return the analysis result, as described in the Privacy Policy.

7. Intellectual property

The App, including its design, branding, text and software, is owned by us or our licensors and is protected by intellectual-property laws. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App for your own personal, non-commercial use, subject to these Terms and the App Store's terms.

8. Third-party services

The App relies on third-party services to deliver certain features (including Apple HealthKit, Apple's App Store, Anthropic's Claude AI for meal analysis, and exercise/food reference databases). Your use of those features may be subject to the relevant third party's terms, and we are not responsible for third-party services or content.

9. Australian Consumer Law

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that you have under the Australian Consumer Law or other law where it cannot lawfully be excluded.

10. Disclaimers and limitation of liability

To the maximum extent permitted by law, and subject to section 9, the App is provided "as is" and "as available" without warranties of any kind, and we do not warrant that it will be uninterrupted, error-free, or that any insight, estimate or prediction it produces will be accurate. To the maximum extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss arising from your use of the App. Where our liability cannot be excluded but can be limited, our liability is limited, at our option, to re-supplying the relevant service or paying the cost of having it re-supplied.

11. Changes to the App or these Terms

We may update, change or discontinue features of the App, and we may update these Terms from time to time. The "Last updated" date above reflects the latest version, and material changes will be communicated within the App. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.

12. Termination

You may stop using the App at any time by uninstalling it. We may suspend or terminate your access if you breach these Terms or misuse the App.

13. Governing law

These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of that jurisdiction.
